A Miami physician was sentenced to 30 years imprisonment and her nurse to seven years imprisonment for $11 million HIV infusion fraud scheme.
Wednesday's sentence of U. S. District Court Judge Federico Moreno on Dr. Ana Alvarez-Jacinto, 54, and Sandra Mateos, 44, was one of the stiffest punishments meted in a federal Medicare fraud case. Both have also been ordered to serve three years of supervised release after their prison terms and pay $8.3 million in restitution to the Medicare program.
Both the convicts worked at St. Jude Rehab Center, a Miami clinic that claimed to specialize in treating AIDS patients. Carlos and Luis Benitez, were the owners of the clinic.
Alvarez-Jacinto was paid a salary of $100,000 for making fake prescriptions for expensive HIV infusion drug called WinRho, which was not required by the patients.
It is alleged that Carlos, Luis and Jose Benitez were the masterminds of a large-scale HIV infusion fraud that operated throughout South Florida and involved at least 11 clinics, including St. Jude. All three Benitez brothers remain at large.
