In a breach-of-contract lawsuit filed against Anthem Blue Cross over a liver transplant, trial has begun.
On Monday defense lawyer Scott Glovsky told a Los Angeles Superior Court jury that Anthem should shell out about $205,000, which is estimated to be the cost of an out-of-state liver transplant for 62-year-old Ephram Nehme as if he waited to get his surgery at the ULCA, he would have died.
Blue Cross has however denied being wrong. If you go by attorney William von Behren then no evidence was there that Nehme would have died had he waited to have the transplant in California. And Nehme left the insurer with no compulsion of paying for his out-of-state care by going out of the Blue Cross coverage network, von Behren said.
Ng said, "We understand that when you handle thousands of claims, human error is a factor. But it looks like that there may be something else going on, which is why we started the enforcement action."
