Actor Lillo Brancato, who appeared on six episodes of the hit HBO series 'The Sopranos' as a wannabe mobster, was acquitted Monday of second-degree murder of an off-duty New York City police officer in 2005. However, he was found guilty of attempted burglary, and faces from three to fifteen years in prison.
Brancato's attorney, Joseph Tacopina said the actor could get credit for time served, since he has been behind bars nearly three years. His sentencing is January 9.
According to prosecutors, Brancato, 32, and accomplice Steven Armento, 48, broke into a basement apartment to steal prescription drugs after a night of drinking at a strip club in December 2005. Officer Daniel Enchautegui, 28, who lived next door, came out to investigate.
Armento blasted the officer with his .357 Magnum, hitting him in the heart. Trying to interrupt the alleged robbery, the dying officer managed to shoot both suspects multiple times. Armento was convicted earlier this year of first-degree murder and was sentenced to life in prison without parole in November.
During his trial, Brancato testified there was a never a break-in. He claimed that he had known the owner, a Vietnam veteran, for several years, and had permission to go inside and take pills - which were part of a drug problem - whenever he felt like it. He said didn't know the man had died earlier that year.
He told the jury that while suffering from judgment-impairing heroin withdrawals on the night of the shooting, he accidentally broke the kitchen window of the apartment in a desperate attempt to wake up his old pill-supplier.
