Nokia appealed for disapproval of the anti-trust allegations charged by Apple on Friday. Nokia asks for this dismissal as according to them, the allegations were planned and that they aim at deflecting the attention "away from free-riding off of Nokia's intellectual property". This statement comes from Wilmington, court papers cited by Bloomberg.
This legal battle was initiated by Nokia by taking a legal action against Apple regarding some ten patent disobedience concerning UMTS (3G), WiFi connectivity and GSM. This step was thrown a reaction by Apple who in turn charged the former with some of its own copyright claims which included violation and willful sustaining the custody of patent information. Apple also blamed Nokia of asking for unfair and unjust payment in form of royalties.
Nokia alleges Apple for turning baseless debate into a multi-count federal law suit by the help of unproven facts, deceptive characterization and ambiguous litigation theories.
The company blames Apple of "revisionist history, misleading characterizations, unsupported allegations and flawed and contradictory legal theories to turn these fruitless negotiations into a multi-count federal lawsuit."
Each of the combatants is asking the US International Trade Commission (ITC) to stop importing phones of the other party. Final decision is expected by June 2011 by ITC. However it has been reportedly said that both the legally involved companies are urging the hearing to be in 2012.
