Just because Microsoft is a huge and prominent name, it will not automatically be the winner everywhere, and this has now been reinforced, all thanks to the U. S. District Court for the Eastern District of Texas, dubbed the patent lawsuit capital of the world. VirnetX, a Silicon Valley company, has been awarded damages worth $105.75 Million in a patent suit against Microsoft.
Microsoft had, it seems, infringed two of VirnetX's patents, and the suit was filed in 2007.
Many are shocked with the decision, and rightly so too. Microsoft infringing patents is a huge thing in itself, and then the company not being able to get away with it is an even bigger surprise. Why, you ask? Well, because it is a giant company! The reason does not make much sense, I know, but sometimes these majors tend to think that everything would just fall in their favor at all times, and then when something like this happens, it is a huge shock.
Microsoft's loss should be viewed as an important lesson for many of the other technology giants who are now getting entangled with one patent infringement lawsuit after another.
The notorious battle of patents between Nokia and Apple is not a secret. Both the companies, major ones in their own respect, have been attacking and accusing each other of blatantly infringing patents. And rumor has it that Apple could now be facing some trouble in the iPad world as well. Why is that not surprising? Probably because Apple tends to think that everyone is infringing all its patents, first with the iPhone and now with the iPad.
Microsoft, obviously, does not believe that it has infringed any patents and is now all set to appeal against the verdict. Again, this does not surprise me in any way.
Maybe some other giants, however, should reconsider their own lawsuits. Seems like the law does not always favor the strong.
