Ten States to File a Lawsuit against New Health Care Reform Bill

Florida’s Attorney General Bill McCollum announced that as many as ten states are planning to file a federal lawsuit against the new health care reform bill.

The lawsuit will be filed only after President Obama signs the health care bill into law, according to what Bill McCollum, who is working under fellow Republican Gov. Charlie Crist, told a news conference.

He also mentioned that soon he will be joined by his counterparts in South Dakota, Texas, Utah, Nebraska, North Dakota, Alabama, Pennsylvania, South Carolina and Washington.

Virginia's Republican Attorney General also gave his nod to file a lawsuit challenging the health care bill. It is still not made public whether Virginia would join hands with other states in filing the lawsuit or will proceed on its own.

According to Democratic sources, the U. S. House of Representatives passed the bill on Sunday night and President Obama will be signing it on Tuesday. The bill’s provision of requiring people to purchase health insurance will be challenged by this case.

McCollum said, “This is a tax or a penalty on just living, and that's unconstitutional. There's no provision in the Constitution of the United States giving Congress the power to do that”.

Some portions of the bill will force the states to spend the funds that they even don’t have. McCollum called it as a violation of the 10th Amendment to the Constitution.
