If the draft bill to regulate IVF in India is declared to be a law, it will become impossible for the male couple from Australia and other countries to hire surrogates from India.

R. S. Sharma, the Secretary of the Committee is busy these days, in writing a bill in order to chalk out regulations for assisted reproductive technology. It was informed to Sydney Morning Herald that the gay couples will not be allowed to hire surrogates unless and until the gay and lesbian relationships are legalized in India.

A 150-year-old section of the country's penal code has been overturned by Delhi's High Court. The gay activists criticized the ruling. Dr Sharma, Deputy Director-general of the reproductive health and nutrition division at the India Council of Medical Research said, "If our government does not permit gay relationships, then it certainly will not be permitted for foreign gay couples to come to this country and have a [surrogacy] agreement”.

The gay couples residing abroad are not happy with the new possibility and confirm it to be a great disappointment. If the draft bill is passed, the Australian Couples will face a lot of difficulty in using Indian surrogates.
