In a one-of-its-kind divorce case, which medical ethicists already say is a nonstarter, a Long Island surgeon either wants the kidney - that the donated to his wife - back, or else is seeking a $1.5 million settlement for the donated organ!
Dr. Richard Batista, a surgeon at Nassau University Medical Center since 1992, donated his kidney to his wife, Dawnell Batista, in June
2001, in order to save her life after she had undergone two unsuccessful kidney transplants.
At a news conference in Garden City, Dr. Batista, 49, said that the second thing he looked forward to, after his kidney was transplanted to his wife, was turning around their marriage which had been rickety because of Dawnell's illness.
However, Dawnell Batista, a 44-year-old nurse, filed for divorce in July 2005, which her husband countersued the same year.
Dr. Batista's attorney, Dominic Barbara, said the demand for the kidney was not part of the original countersuit; it was the latest introduction, after Dawnell did not allow him the agreed-upon visitation with the couple's three children- who are aged 14, 11 and 8.
Dr. Batista said: "This is my last resort," adding that when he gave his kidney to his wife, he "did the right thing for her and to this day I would do it again." But, he claims that though Dawnell filed for divorce in 2005, she began having an extramarital affair within two years after receiving his kidney.

Okay if the initial report on CBS was right this morning the way the story went was
• The man and wife were married
• She became ill
• Hubby donated kidney out of love
• She began an affair just 2 years later after that act of kindness
• She filed for divorce to be with the new guy (who probably wouldn’t give her a kidney)
• If the husband had had the affair a ton of women would be after this guy trying to rip his kidney out to give to the soon-to-be ex-wife.
So I side with the husband on this… I think he should get the kidney back (or to be humane compensated) – he is not the bad guy the wife is.
What if he gets a new wife, who may truly love him needs a kidney and he is a match… he can’t give her that kidney it has been wasted on the cheating ex.
An adulterer is just that and regardless of the gender they should get the scarlet letter and give back all gifts.

OMG, women have affairs! I thought females did no wrong and were perfect, obviously he is emotionally hurt and I doubt he would actually accept the kidney anyway.
