Samantha Geimer, 45, who director Roman Polanski is said to have raped three decades ago, when she was just thirteen and a minor, lashing out at the Los Angeles County District Attorney's office, would prefer the case to be dismissed, as the prosecutors' focus on lurid details of her rape, has her victimized all over again.

Geimer, now a wife and mother to three children, has filed for the case to be dismissed, as fresh publications of the case can only result in further traumatization, as the prosecutors and the court's insistence that Polanski appear in person to seek dismissal 'is a joke, a cruel joke being played on me.'

However, Polanski, a fugitive in his native France, risks arrest the moment he steps on American soil, which makes the court's motion for dismissal scheduled for 21st January and ordering him to stand before it to make the request, so ludicrous.

Geimer, says in her declaration sighed at her home in Kilauea , Hawaii : 'If Polanski cannot stand before the court to make this request, I, as the victim, can and I, as the victim do.' Further, 'I have survived, indeed prevailed, against whatever harm Mr. Polanski may have caused me as a child,' adding she now believes Polanski fled 'because the judicial system did not work.'

She also states that her feelings were never considered nor was she consulted when the prosecution document was filed. As well, the reason why Polanski pleaded guilty to a single count of unlawful sexual intercourse, was with the intention of saving her from a trial that would have drawn worldwide attention.

Sandi Gibbons, the district attorney's spokeswoman refused to comment, as Geimer's declaration is part of pending litigation.
