Federal Judge Rejects Government’s Request to Dismiss Health Care Lawsuit

On Thursday, a Chief Prosecutor of South Carolina commended a Federal Judge's decision to let a lawsuit over portions of the package to undergo trial.

Attorney General, Henry McMaster while talking to The Associated Press said that for the states it is a victory and this is a fight which must be won.

McMaster commented after going through a 65-page order that was issued by Judge Roger Vinson of U. S. District, who is handling the case filed by Florida Attorney General Bill McCollum.

The lawsuit was filed by McCollum just after President Barack Obama approved the 10-year $938 billion health care bill in the month of March.

Under the new health reform law, it will be mandatory for the people of the United States to acquire a health insurance policy, otherwise they will be fined through taxes. The prosecutors are saying that Government’s new health law is totally unconstitutional.

Judge Vinson rejected the Obama administration’s appeal to dismiss the case. He said that he is interested in hearing more arguments on the health insurance issue.

Another Federal Judge from Michigan also filed a similar lawsuit for the health care law and it is expected that the decision on both the cases will be taken in the U. S. Supreme Court.
