PearC selling Apple Mac clones in Germany

It's disturbing news for Apple that PearC is selling the clones of the Apple Macintosh in Germany. After Psystar, PearC is latest company to vex Apple; Psystar was selling Apple Mac clones in United States, while PearC is selling in Germany.

According to reports, PearC is only selling the clones of the Apple Macintosh in Germany, using a twist on German law as legal protection. PearC is taking advantage of legal loophole.

On the issue, a PearC spokesman offered the argument that "since Apple's Mac OS X EULA is inside the box and not able to be viewed until the box is opened, the document has no legal validity in Germany".

Like Psystar, which is offering new legal arguments that it has rights to sell systems that can load Mac OS X, PearC is avoiding an end-user license agreement (EULA) for Mac OS X that forbids third-party installations of Leopard.

According to reports, PearC "Starter" price range starts at _499. Its "Advanced" model is priced at _799, while the "Professioonal" costs _1,499. PearC "Starter" configuration includes a rather basic dual-core Intel 2.2-GHz E2200, while the Professional packs a
2.67-GHz Core i7 920 and a base configuration of 6 Gbytes of DDR-3 DRAM. PearC also offers choice to install either Apple OS X or Windows Vista Home Premium as the base operating system; Windows XP Professional and Windows Vista Ultimate are both listed as upgrades.

Now, the big challenging for Apple, which has not yet offered any official comment on the issue, is that how to stop sales of Apple Mac clones in Germany.
