RIM Loses Trademark Lawsuit to Basis

There seems to be no end to worries for RIM as now it has been told that instead of using “BBX” on the smartphones, they would be changing the name to BlackBerry 10. This sudden change in the plans is linked to a recent case where software company Basis International had asked for a restraining order against the Canadian company to use the already registered name BBX on their phones to be released in 2012.

Though Basis had earlier requested RIM to rethink about using the trademark, RIM seems to have overlooked the severity of the case. This made Basis to go for legal route which made U. S. District Judge William P. Johnson in Albuquerque, New Mexico, to rule that RIM cannot use the trademark at the DevCon conference in Singapore.

Though both the companies are into different fields, there is not much difference in the trademark used. This could make many users of Basis’ BBX software confuse and thus, it is required to draw a line there.

There are no comments received on this legal matter from RIM as of now. “The alleged infringement is likely to cause customers and prospective customers to wrongly believe that the software applications created using BASIS’s development tools are only compatible with RIM’s BBX operating system”, said the court.

While the matter could have been settled easily between the two, it seems that the RIM could not gauge the exact level of seriousness of the request made by the company after RIM unleashed its plans about its new platform called BBX for smartphones, tablets and embedded systems in October.

There is need for companies to understand that trademark matters are not that easy to resolve and at times, it becomes imperative to heed even minor words of caution.
