N.Y. Police Officer Charged With Sodomy

The lawyer for Officer Richard Kern, 25, a New York City police officer, confirms his client is expected to be charged with beating and sodomizing a man with a police baton on a subway platform. Accused of leading the assault, Kern has been ordered to surrender to police Tuesday for processing and arraignment.

Michael Mineo, 24, who works at a tattoo parlor, was approached by several uniformed police officers early afternoon on 15th October near Brooklyn's Prospect Park, on suspicion of smoking marijuana. Following Mineo into a nearby subway station, he says he was forced him to the ground and handcuffed him. Mineo says he screamed in pain as something was forcibly shoved up his rectum. His lawyers later confirm that something was a police baton and the incident reminiscent of Abner Louima, a Haitian immigrant attacked with a broomstick in a Brooklyn police station in 1997, sparked sparked charges of police brutality.

The office of Brooklyn District Attorney Charles Hynes has refused to comment, as the grand jury indictment is still under seal and it is not known yet, whether Officers Alex Cruz and Andrew Morales, the other two officers who participated in the assault, have also been indicted by the jury.

Stephen Jackson, Mineo's lawyer says his client who is still suffering from his physical and emotional wounds, is 'extremely pleased' with the news of the indictment.

John Patten, Officer Kern's lawyer says his client maintains his and is unaware of the charges he may have to face. But, a transit officer, among the four who helped to subdue Mineo, testifying in front of the grand jury stated he saw Kern wield a baton and put it near Mineo's buttocks. Since, Officer Richard Kern and the other co-accused had been placed on modified assignment since the incident.

Co-incidentally, one New York City police officer in Louima's case, received a 30-year prison sentence for his role in the attack, while a second officer was given 5-years for perjury.

The 1997 case stoked racial tensions in the city, due to the fact that Louima was a yonng, black male, and the officers white. In this case, Mineo is white, and the officers are black, white and Hispanic.
