SC turns down emergency appeal about Obama’s nationality

An emergency appeal from Leo Donofrio, a retired lawyer from East Brunswick, New Jersey, has been turned down by the Supreme Court on Monday - the man claimed that President-elect Barack Obama was ineligible to become the US President, since he is not a "natural born" citizen. In its order, the court also said it had denied Donofrio's request for a stay.

The justices are likely to reject Donofrio's appeal in a few weeks.

The court order is a setback for a group of unrelenting litigants who want that Obama should not take office - the basis of their assertion is that his Hawaiian birth certificate, showing he was born in Hawaii on August 4, 1961, is not correct. They argue that Obama is ineligible to be the president because his father was a Kenyan.

Even though the case had little chance of being heard at the high court, it still had become the subject of tremendous speculation and debate on ideological political blogs. The controversy, particularly prominent in the conservative blogosphere, is based on the provision in the Constitution that says, "No person except a natural born citizen … shall be eligible to the office of president." According to law, any person born in the US is considered a natural born citizen.

Despite the court's order, the controversy and the lawsuits about Obama's nationality are far from over. Two other cases have reached the Supreme Court, which only decides legal issues involving federal law and the Constitution - it does not resolve factual disputes. There are other pending lawsuits involving Obama's birth, which say state officials should investigate his Hawaiian birth certificate to see whether it is valid.

Moreover, there is an appeal petition, pending at the high court, which claims Obama was born in Kenya.
