The Food and Drug Administration stated in a letter that Nestle SA’s Juicy Juice and Boost beverages for children violated U. S. rules about marketing health claims.

“It is your responsibility to ensure that all of your products are in compliance with the laws enforced by FDA,” the agency wrote to Nestle, world’s biggest food company.

The FDA also said several nutritionally complete brand drinks meant for kids is being promoted as medical food with no added sugar but the food fails to meet the standards.

Under the leadership of Commissioner Margaret Hamburg and deputy Joshua Sharfstein, two former city health commissioners, the agency has been coming down heavily on health claims made to consumers this year.

The FDA said a review done on labeling of Nestle products like Juicy Juice Brain Development Fruit Juice Beverage (Apple), Juicy Juice All-Natural 100% Juice Orange Tangerine and Juicy Juice All-Natural 100% Juice Grape confirmed that the products were violating the federal law.

The FDA pointed out at Nestle’s promotion of some of its products as medical food that was suitable for treating failure to thrive in newborns and for pre/post surgery, injury or trauma, chronic illnesses.

The FDA said medical food was “A food which is formulated to be administered by a physician which is intended for managing a condition for which distinctive nutritional requirements were needed, based on recognized scientific principles.”

The FDA warned of facing action if Nestle failed to bring its marketing of the drinks into compliance with federal laws. For this the company has a time period of 15 days.
