Although no decision on the issue have been taken yet, Friday did see an uproar on the same in the U. S. Court of Appeals in DC, and it does not seem that the FCC will be prevailing in exerting its authority over Comcast, and losing this battle with the company might just be what the FCC needs to actually go ahead with its efforts to formalize the net neutrality guidelines, which it has been resounding for quite some months now.
The case which was being argued on Friday is an appeal which has come from Comcast's side with regards to sanctions that are being imposed on it by FCC for allegedly discriminating against "peer-to-peer networking file traffic in an effort to throttle bandwidth demand on its broadband network". Comcast says that FCC has no such authority or right.
The Court challenges the FCC decision to sanction Comcast-validating requirement for formal rules over net neutrality. Julius Genachowski, FCC Chairman, has shared that the agency has acted based on the Four Freedoms that have been outlined by the prior FCC Administration of 2005, and these principles might not be formal rules, but have been used to govern net neutrality on individual basis.
The Court and Comcast arguments might just lead to the FCC formalizing these rules.
